This article is proposed to broaden the historiographic horizons of the participation of underling groups in the historical processes of New Granada. This paper makes part of a research project intended to report the actions carried out by the plebs of Santa Fe de Bogota at the dawn of independence. This project is aimed at revealing the cotidianity of those subjects invisibilized by official history, like the indigenous, mestizo, mulatto, African-American and poor people; the mass or the plebs, as they (...) have been labeled. Este estudio de relaciones médico-paciente en Mexico involucró entrevistas realizadas a 1700 pacientes inmediatamente de.\pués de salir de su consulta clínica. Se llevó a cabo entre los años 2004-05 en León, More ha, Guanajuato y en Charleston, West Virginia, USA. Los propósitos fueron: 1) establecer un base de datos como punto de referencia para investigaciones futuras en instituciones del cuidado de la salud con referencia a la comunicación médico-paciente, a la satisfacción de los pacientes y al consentimiento infórmado y, 2) (...) hacer una comparación entre las relaciones medico-paciente en Mexico y los Estados Unidos de America. Hicimos varias conclusiones sobre la comunicación médico-paciente, participación del paciente en decisiones con respecto a su cuidado de salud y el ambiente social de la consulta médica. Ofi-ecemos los datos y los cuestionarios completos por internet a cualquier investigador interesado para estudios futuros de acuerdo con sus propios intereses. Además, encontramos que no huho ninguna diferencia importante en las relaciones médico-pacientes con respecto al consentimiento infórmado y la satisfáccián del paciente entre México y los EEUU. From the context of conceptual references related to this period, we will work on the concept of “hegemony”, which will be addressed based on Antonio Gramsci’s category. This paper aims to unravel the different political interests during a time of national unity that prevailed since the two-party system was established. Our general goal is to contribute to the discussion and analysis of our political (...) culture from a historical perspective, mostly of the student community, which, once inserted in the country’s reality, can take a stand regarding political events, thereby stopping dominance and hegemony based on National Unity agreements from becoming new totalitarian forms of “democracy”. The creation of the prison camp at the U.S. naval base in Guantánamo Bay, Cuba is part of a historical continuity of colonialism on the island. Over two hundred years before the United States sent the first "enemy combatants" to Cuba, the Spanish Empire began sending "enemy Indians" to the island. The rationales and circumstances that gave rise to the prison complex in Guantánamo share much in common with those that motivated Spain to imprison Apaches and other Native people on (...) Cuba. Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. This essay surveys the present position of postmodernism with respect to the effect of its ideas upon historiography. For this purpose it looks at a number of writings by historians that have been a response to postmodernism including the recently published collection of articles, The Postmodern History Reader. The essay argues that, in contrast to scholars in the field of literary studies, the American historical profession has been much more resistant to postmodernist doctrines and that the latters' influence upon the (...) thinking and practice of historians is not only fading but increasingly destined to fade. The essay also presents a critical discussion of the current philosophy of postmodernism in its bearing upon historiography, directed chiefly against its claim that the world has undergone an epochal transition from the modern to a postmodern age; its theory of language and linguistic idealism; its opposition to historical realism and denial of the actuality of the past as a possible object of reference; and its theory of historical narrative as unconstrained fictional construction. This discussion includes a consideration of the work of postmodernist thinkers such as J.-F. Lyotard, of the recent books by David Roberts and Robert F. Berkhofer, Jr. which espouse a postmodernist theory of history, and of the narrativist theory of Hayden White. The essay also notes some of the reasons for postmodernism's appeal; and while it does not deny that postmodernist philosophy may have served a useful purpose in provoking historians to be more self-critical and aware of their presuppositions and procedures, it maintains that its skeptical and politicized view of historical inquiry is deeply mistaken, out of accord with the way historians themselves think about their work, and incapable of providing an understanding of historiography as a form of thought engaged in the attainment of knowledge and understanding of the human past. Despite the central presence of materialism in the history of philosophy, there is no universal consensus on the meaning of the word “matter” nor of the doctrine of philosophical materialism. Dictionaries of philosophy often identify this philosophy with its most reductionist and even eliminative versions, in line with Robert Boyle’s seventeenth century coinage of the term. But when we take the concept back in time to Greek philosophers and forward onto our own times, we recognize more inclusive forms of (...) materialism as well as complex interplays with non-materialist thought about the place of matter in reality, including Christian philosophy and German idealism. We define philosophical materialism in its most general way both positively (the identification of reality with matter understood as changeability and plurality) and negatively (the negation of disembodied living beings and hypostatized ideas). This inclusive approach to philosophical materialism offers a new light to illuminate a critical history of the concept of matter and materialism from Ancient Greece to the present that is also attentive to scientific developments. By following the most important connections and discontinuities among theoretical frameworks on the idea of matter, we present a general thread that offers a rich and plural, but highly cohesive, field of investigation. Finally, we propose building on rich non-reductionist materialist philosophies, such as Mario Bunge’s systemic materialism and Gustavo Bueno’s discontinuous materialism, to elaborate powerful theoretical alternatives to both physicalism and spiritualism. Utilitarianism, the great reforming philosophy of the nineteenth century, has today acquired the reputation for being a crassly calculating, impersonal philosophy unfit to serve as a guide to moral conduct. Yet what may disqualify utilitarianism as a personal philosophy makes it an eminently suitable guide for public officials in the pursuit of their professional responsibilities. Robert E. Goodin, a philosopher with many books on political theory, public policy and applied ethics to his credit, defends utilitarianism against its critics and (...) shows how it can be applied most effectively over a wide range of public policies. The United States Army’s Future Combat Systems Project, which aims to manufacture a “robot army” to be ready for deployment by 2012, is only the latest and most dramatic example of military interest in the use of artificially intelligent systems in modern warfare. This paper considers the ethics of a decision to send artificially intelligent robots into war, by asking who we should hold responsible when an autonomous weapon system is involved in an atrocity of the sort that would normally (...) be described as a war crime. A number of possible loci of responsibility for robot war crimes are canvassed; the persons who designed or programmed the system, the commanding officer who ordered its use, the machine itself. I argue that in fact none of these are ultimately satisfactory. Yet it is a necessary condition for fighting a just war, under the principle of jus in bellum, that someone can be justly held responsible for deaths that occur in the course of the war. As this condition cannot be met in relation to deaths caused by an autonomous weapon system it would therefore be unethical to deploy such systems in warfare. (shrink)

Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

Nozick argues, in “Anarchy, State, and Utopia”, correctly I think, that we can go from an equal distribution of wealth to an unequal one through just means. Nozick then asks: If people voluntarily move from a just distribution of wealth, D1, to a different distribution, D2, “isn’t D2 also just?” While Nozick thinks the new distribution of wealth, D2, is just, I think that it is at least possible to go from a just state of affairs to an un-just state (...) of affairs by just means. I then argue that any unequal distribution of wealth can not maximize the good derived from wealth. Therefore, on the basis of plausible utilitarian ideas, any distribution of wealth that isn’t at least roughly equal is un-just, even it was arrived at by just means from aa equal and just distribution of wealth. Given the restrictions of space (a limitation they too had to contend with), we can only respond to a few aspects of their interesting (...) remarks. We shall reply of course on the basis of our own approach—an approach that sets out to integrate culture, behavior, and experience, and that might be termed contextual phenomenology, phenomenological behaviorism, or perhaps most accurately (albeit more awkwardly), the phenomenological–behavioral perspective.In her commentary, Ibáñez-Guerra (2008), referring to the target articles “Phenomenology and behaviorism” (Pérez-Álvarez, Sass, and Cangas 2008) and “The role of superstition in psychopathology” (García-Montes et al. 2008), wonders whether our maintaining of the spirit of Skinner, as well as our recourse to phenomenology, might not themselves represent forms of superstitious behavior. She points out that it is not always a good idea to put new wine in old barrels. For her, the new wine and new barrels would be represented by social constructivism, of which she is reminded by some aspects of our work. But in making her own case, Ibáñez-Guerra (2008) reveals certain common prejudices concerning behaviorism, prejudices that have apparently persisted even after reading our article. Thus, for example, she does not see operant behavior as incorporating intentionality (what, in the target article, is presented in terms of final causality), because she assumes that intentionality would necessarily imply a mentalist and dualist notion involving a supposed internal mental entity that causes behavior. Skinner (1974) himself noted and rejected this very assumption in a passage that clearly distinguishes his own approach from what he calls a “stimulus-response formula”: “Possibly no charge,” he wrote,is more often leveled against behaviorism or a science of behavior than that it cannot deal with purpose or intention. A stimulus-response formula has no answer, but operant behavior is the very field of purpose and [End Page 281] intention. By its nature it is directed toward the future: a person acts in order that something will happen, and the order is temporal.(pp. 55–6)The place Skinner gives to intentionality and purpose is elaborated in our target article.Furthermore, Ibáñez-Guerra (2008) assumes that, on methodological grounds, Skinner rejects all that is not observable, or at least that cannot be operationalized. This, however, is simply incorrect, at least as regards Skinner’s radical behaviorism. As the reader may recall, radical (as opposed to methodological) behaviorism is neither operationalist nor does it reject private or subjective events because of their unobservability. Indeed, Skinner specifically acknowledges that such events are in fact observable—at least for one person: the subject him- or herself. The question for Skinner is to understand how the part of the world that is only observable and experiential for oneself is constructed or formed. In the end, it turns out that radical behaviorism is more radical, in the Aristotelian ontological sense (see Pérez-Alvarez, Sass, and García-Montes 2008), than post-modern constructionism. Indeed, as we remarked, radical behaviorism can still surprise us today. Similarly, phenomenology is starting to be missed in the clinical context (Andreasen 2007). We believe that radical behaviorism and phenomenology, mutually readjusted, are in fact excellent wines for the times we live in—if only we knew how to appreciate them.In their commentary on “Phenomenology and behaviorism: A mutual readjustment,” Fletcher and Hayes (2008) argue that the philosophy and theory of Acceptance and Commitment Therapy (ACT)/Relational Frame Theory (RFT) already contain the salutary aspects of phenomenology that we highlight in our target article. Their insistence on reducing the affinities we find between phenomenology and behaviorism to ACT/RFT consists, in our view, in a scientific–technical argument that is more scientistic than strictly philosophical in nature. At the heart of this book is the age-old question of how law and morality are related. The legal positivist, insisting on the separation of the two, explicates the concept of law independently of morality. The author challenges this view, arguing that there are, first, conceptually necessary connections between law and morality and, second, normative reasons for including moral elements in the concept of law. While the conceptual argument alone is too limited to establish a sufficiently strong connection between law (...) and morality, and the normative argument alone fails to address the nature of law, the two arguments together support a nonpositivistic concept of law, toppling legal positivism qua comprehensive theory of law. In this context, it mostly denotes a digital substitute for a real object or process. Virtual reality is perhaps the best-known term in this respect. With these digital (...) connotations, “virtuality” has also been used in science and research: Chemists use virtual laboratories, biologists do virtual scanning of molecular structures, and geologists engage in virtual field trips. But the concept of the virtual has a much longer tradition, dating back to long before the dawn of the digital age. Virtual images and virtual displacements were introduced in classical physics already in the late seventeenth and eighteenth centuries, respectively. They represent auxiliary objects or processes without instantiation, with the purpose of efficiently describing specific physical systems. In today’s physics, the term “virtual” is mostly associated with the quantum world, first and foremost with the “virtual particle” of quantum field theory. It has become such an integral part of modern high energy physics that its ontological character may be considered to go beyond the purely auxiliary, which is typically associated with the virtual. [End Page 263]In other disciplines, however, use of the term virtual without a digital connotation is much rarer. This essay presents a version of divine command metaethics inspired by recent work of Donnellan, Kripke, and Putnam on the relation between necessity and conceptual analysis. What we can discover a priori, by conceptual analysis, about the nature of ethical wrongness is that wrongness is the property of actions that best fills a certain role. What property that is cannot be discovered by conceptual analysis. But I suggest that theists should claim it is the property of being contrary to the (...) commands of a loving God. This claim, if true, is a necessary but not an a priori truth. It also is a claim, not about the way in which some believers use the word 'wrong,' but about the wrongness that virtually everyone talks about. A lo largo de la tradición psicopatológica, incluso de la pre-fenomenológica, se encuentra la categorización del delirio como creencia. Jaspers asumió ese uso y lo fundó fenomenológico-existencialmente, definiendo su carácter de convicción. El concepto de creencia ha tenido un largo recorrido dentro de la historia del pensamiento, aunque recientemente se ha intensificado el debate acerca de la visión doxástica del delirio. En virtud de lo ya mencionado, en el presente artículo presentamos un análisis conceptual de la creencia, con el objetivo (...) de identificar de manera precisa los aspectos esenciales que permiten al delirio definirse según ella. De esta manera, se discutirán algunas de las principales incursiones realizadas en el concepto desde la antigüedad periplatónica hasta José Ortega y Gasset, remarcando en cada pensador las directrices esenciales de su aproximación a la creencia. A su vez, introducir al filósofo español al debate psicopatológico permitirá incluir en la discusión dos aspectos importantes que creemos pueden ser fructíferos para la discusión filosófica sobre el delirio: la diferencia entre ideas y creencias, y la vitalidad de estas últimas. This study of the political philosophy of William Ernest Hocking be gan as a doctoral dissertation at Tulane University. Hocking (1873- 1966) was for many years Alford Professor of Natural Religion, Moral Philosophy, and Civil Polity at Harvard University. Although he is relatively well-known among American philosophers, particularly by students of metaphysics and the philosophy of religion, very little atten tion has been given to his political philosophy. Some general studies of his thought summarize his political writings in a very (...) cursory fashion, but they do not discuss his contributions in detail or relate them to significant issues in political philosophy. Most important general works on modern political philosophy or American political thought do not even mention Hocking; a few note his name in passing. Because he is almost completely unknown in the social sciences, the original purpose of this study was to explore, systematize, and present his extensive writings in political philosophy. It then became apparent that his entire political philosophy is oriented around the concepts of liberty and community. When his thought is analyzed in terms of these themes, its unity and coherence are more obvious. Moreover, his writings become more significant when they are related to liberty and community, for these are focal concepts for important problems in modern political philosophy. This study of Hocking's political philosophy will, it is hoped, help us to see how liberty and community can be more understandable, attainable, and compatible with one another. (shrink)

There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. According to the necessity thesis, the legitimacy of proportionality analysis is (...) a question of the nature of constitutional rights, according to the contingency thesis, it is a question of interpretation. Lower extremity non-contact soft tissue injuries are prevalent in elite futsal. The purpose of this study was to develop robust screening models based on pre-season measures obtained from questionnaires and field-based tests to prospectively predict LE-ST injuries after having applied a range of supervised Machine Learning techniques. One hundred and thirty-nine elite futsal players underwent a pre-season screening evaluation that included individual characteristics; measures related to sleep quality, athlete burnout, psychological characteristics related to sport performance and self-reported perception of chronic (...) ankle instability. A number of neuromuscular performance measures obtained through three field-based tests [isometric hip strength, dynamic postural control and lower extremity joints range of motion ] were also recorded. Injury incidence was monitored over one competitive season. There were 25 LE-ST injuries. Only those groups of measures from two of the field-based tests, as independent data sets, were able to build robust models [area under the receiver operating characteristic curve score ≥0.7] to identify elite futsal players at risk of sustaining a LE-ST injury. Unlike the measures obtained from the five questionnaires selected, the neuromuscular performance measures did build robust prediction models. The inclusion in the same data set of the measures recorded from all the questionnaires and field-based tests did not result in models with significantly higher performance scores. The model generated by the UnderBagging technique with a cost-sensitive SMO as the base classifier and using only four ROM measures reported the best prediction performance scores. The models developed might help coaches, physical trainers and medical practitioners in the decision-making process for injury prevention in futsal. (shrink)
